A comparative study of the nature and rulings of apostasy in the five schools of Islamic jurisprudence

Document Type : Original Article

Abstract

Apostasy is one of the significant issues in political jurisprudence and holds considerable importance. In all Islamic schools of thought, apostasy is regarded as a crime against religion and belief and is subject to severe punishment. Given the gravity of its prescribed penalties, several questions become particularly salient: whether the criminalization of apostasy is in conflict with the principle of human religious freedom; through what means this crime can be established; what its legal effects and consequences are; and how its rulings are treated across the five schools of Islamic jurisprudence.
In this study, the author employs a descriptive–analytical method and relies on library-based sources to, first, clarify the concept of apostasy, then explain its rulings and effects, examine the conditions for its realization and the methods of proving it, and finally elucidate the relationship between apostasy and the principle of human freedom. The findings and conclusions of the research indicate that the criminalization of apostasy does not conflict with the principle of religious freedom. This is because Islam grants human beings the greatest degree of freedom and choice in selecting a religion, allowing them to choose their faith with full awareness and insight, without any form of compulsion. However, once a religion has been accepted, abandoning or changing it is not permissible, since such a change would give rise to numerous problems for Islam and its followers. From this perspective, apostasy is regarded in Islam as a crime against the Islamic order.
