An Examination of the Rebuttal of the Allegation of Violence against the Institution of Qiṣāṣ in Islamic Jurisprudence

Abstract

Qiṣāṣ (retaliatory justice) constitutes one of the most fundamental penal rulings within the Islamic juridical system, the purpose of which is to establish justice and prevent aggression and social disorder. Nevertheless, from a superficial and outward perspective, it has occasionally been portrayed as a manifestation of violence or a violation of human dignity. Adopting an analytical-critical approach, this article examines the allegation of violence against the foundation of qiṣāṣ in Islamic jurisprudence and endeavors to elucidate the relationship between divine justice and humanitarian considerations.
The findings indicate that the perception of qiṣāṣ as violent stems from the Western conception of punishment, which is predicated upon the separation of religion from ethics and justice, whereas in Islamic jurisprudence, qiṣāṣ is accompanied by a spirit of compassion, the possibility of pardon, and blood-money (diyah), and possesses both deterrent and educative dimensions. The article concludes by proposing that a conceptual re-reading of qiṣāṣ based on a humane understanding of justice, alongside the cultivation of a culture of forgiveness, may serve as a pathway toward convergence between juridical teachings and humanitarian rights concerns.
