Abstract

Stipulations incorporated into the marriage contract constitute one of the central issues in Islamic jurisprudence. Owing to social transformations and the emergence of novel conditions in contemporary marriages, this issue has acquired increasing significance. The fundamental question is: to what extent are spouses free to include stipulations in the marriage contract? Is the range of valid conditions confined to those explicitly permitted by Sharīʿa, or are the parties free to agree upon any condition except one that contradicts the Qur’an and the Sunnah?
Using a descriptive-analytical method and a comparative approach, this study examines the foundations, rulings, and legal effects of stipulations in the marriage contract from the perspectives of the Imāmī and Ḥanafī schools of law. To this end, the concepts of condition (sharṭ), contract (ʿaqd), and marriage (nikāḥ) are first clarified in both their lexical and technical senses. The study then investigates the rationale behind the legal recognition of stipulations and explores the disagreement among jurists of the Islamic schools regarding contractual freedom in stipulation, based on the two underlying principles of permissibility and prohibition. The study further explains the Ḥanafī classification of stipulations into valid, defective, and void categories, as well as the Imāmī position, which broadly validates stipulations except those contrary to the Qur’an and the Sunnah. It also analyzes the legal effects of stipulations that do not arise from the intrinsic requirements of the contract, both according to those who hold that fulfillment is obligatory and those who do not.
The findings indicate that the Imāmī and Ḥanafī schools agree on the basic validity of stipulations compatible with the essential implications of the marriage contract; however, they differ regarding the scope of this freedom and its Sharīʿa-based regulations. The Ḥanafī school, drawing on customary practice, classifies stipulations into three categories: valid, defective, and void. By contrast, the Imāmī school, relying on the ḥadīth “al-muslimūn ʿinda shurūṭihim” (“Muslims are bound by their stipulations”), adopts a broader framework for validating conditions. The practical consequence of this disagreement becomes evident in the enforcement of stipulations—particularly the right of rescission—and in the effect of a defective condition on the validity of the contract itself. The study concludes that Islamic jurisprudence, by recognizing a qualified freedom of stipulation, offers a flexible yet principled framework for safeguarding the rights of both parties and preventing familial disputes.
